Terms of Service – Outflow AI

1. Agreement to Terms

By accessing or using Outflow AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"), provided by Individual Entrepreneur ULADZISLAU SHOLAKHAU ("we", "us", "our"). If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Outflow AI is an AI-powered outbound sales automation platform designed for B2B SaaS founders. The Service provides:

Automated Ideal Customer Profile (ICP) synthesis from your product URL and briefing
Lead discovery via third-party data providers
AI-generated personalized cold email sequences
Automated email sending through your connected email account
AI-powered reply classification and auto-response
Calendar booking integration to schedule qualified calls
Campaign analytics, bounce-rate monitoring, and deliverability alerts

The Service orchestrates and connects third-party platforms including Instantly (email sending and lead discovery), Cal.com (calendar booking), and large language model providers. You are responsible for maintaining active accounts with these third-party services where required.

3. Account Registration

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at u.sholakhau@gmail.com if you suspect unauthorized access. Accounts are for individual use only; sharing accounts is not permitted in v1.

4. Subscriptions and Payment

Access to the Service requires a paid subscription. Subscriptions are billed in advance on a recurring monthly or annual basis.

Payment processing. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle appears on your bank or card statement as the seller and manages payment processing, tax calculation, fraud prevention, and remittance on our behalf. By completing a purchase, you also agree to Paddle's Buyer Terms, Terms of Service, and Privacy Policy.

Auto-renewal. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You can cancel at any time from your account settings or the Paddle customer portal. Cancellation takes effect at the end of the current billing period; you retain access until then.

Price changes. We reserve the right to change subscription prices. We will give you at least 30 days' notice before any price change takes effect for existing subscribers.

5. Acceptable Use

You agree not to use the Service to:

Send spam, unsolicited bulk email, or communications that violate anti-spam laws (CAN-SPAM, GDPR, CASL, or equivalent)
Harvest or purchase email lists in violation of applicable law
Impersonate any person or entity or misrepresent your affiliation
Upload or transmit viruses, malware, or any harmful code
Reverse engineer, decompile, or disassemble any part of the Service
Resell, sublicense, or commercially exploit the Service without written permission
Violate any applicable local, national, or international law or regulation
Interfere with or disrupt the integrity or performance of the Service

You are solely responsible for ensuring your outbound email campaigns comply with all applicable laws in the jurisdictions where your prospects are located. Outflow AI provides tooling only and does not provide legal advice.

6. Third-Party Services

The Service integrates with third-party platforms. Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. Key integrations include:

Instantly – email sending infrastructure and lead discovery
Cal.com – calendar booking and meeting scheduling
Anthropic / OpenAI – large language model inference
Firecrawl / Crawl4AI – website scraping
Paddle – payment processing
Langfuse / Sentry – observability and error tracking

7. Intellectual Property

The Service, including its software, design, text, graphics, and logos, is owned by Outflow AI and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business purposes during your active subscription.

You retain ownership of any content you submit (briefings, copy edits, etc.). By submitting content, you grant us a limited license to process it solely to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR BUSINESS OUTCOME, INCLUDING LEADS, MEETINGS, OR REVENUE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUTFLOW AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

You may terminate your account at any time by cancelling your subscription and deleting your account from the settings page.

We reserve the right to suspend or terminate your access immediately, without prior notice, if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately.

Data after cancellation. Following account deletion or termination, your personal data is deleted within 30 days in accordance with our Privacy Policy. Campaign data, leads, and generated email copy are removed at the same time. Export your data before cancelling if you need a copy.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date, or by sending an email to your registered address. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law principles.
